End User License Agreement (EULA)

1. License Grant

Subject to your compliance with this EULA, Wallpyria grants you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Application on macOS devices that you own or control
• Use the Application for personal or commercial purposes in accordance with this EULA
• Receive updates and improvements to the Application as made available

This license is granted for the trial period and, after purchase, without time limit, and may be revoked if you breach this EULA.

2. License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works based on the Application
• Distribute, transfer, sublicense, lease, lend, or rent the Application to any third party
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the Application
• Use the Application in any manner that could damage, disable, overburden, or impair the Application
• Use the Application for any illegal or unauthorized purpose
• Circumvent, disable, or interfere with security-related features of the Application
• Use any automated system or software to extract data from the Application

3. Intellectual Property

The Application and all rights, including intellectual property rights therein, are and shall remain the property of Wallpyria. This EULA does not grant you any rights to trademarks, service marks, or trade names of Wallpyria. All rights not expressly granted to you are reserved by Wallpyria.

You retain all rights to the wallpapers, images, and videos you create or import using the Application. Wallpyria claims no ownership over your content.

4. Trial Period

The Application may be offered with a free trial period:

• The trial covers 14 days of use (only days on which you use the Application count), within 60 days of the first launch
• Full functionality is available during the trial period
• No payment information is required to start the trial
• The trial ends after 14 days of use or 60 days after the first launch, whichever comes first, unless you purchase the Application
• You may only use one free trial per user/device

After the trial period expires, you must purchase a license to continue using the Application.

5. Payment and Refunds

If you purchase the Application:

• Payment is processed through the Mac App Store
• Prices are subject to change with notice
• Refunds are handled according to Apple's refund policy
• Wallpyria is a one-time purchase; there are no subscription renewals
• You are responsible for any applicable taxes

6. Updates and Modifications

Wallpyria may provide updates, upgrades, or modifications to the Application. These updates may add, modify, or remove features. By continuing to use the Application after an update, you agree to the updated version. Wallpyria is not obligated to provide any updates and may discontinue the Application at any time.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• No warranty of merchantability or fitness for a particular purpose
• No warranty that the Application will be uninterrupted, error-free, or secure
• No warranty that defects will be corrected
• No warranty regarding the accuracy or reliability of information obtained through the Application

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALLPYRIA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Business interruption
• Cost of substitute goods or services

IN NO EVENT SHALL WALLPYRIA'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability, so some of the above limitations may not apply to you.

9. Termination

This EULA is effective until terminated:

• You may terminate this EULA at any time by uninstalling and ceasing to use the Application
• Wallpyria may terminate this EULA immediately if you breach any terms
• Upon termination, you must cease all use of the Application and delete all copies
• Sections 3, 7, 8, 10, and 11 shall survive termination

10. Export Compliance

You agree to comply with all applicable export and import laws and regulations. You shall not export, re-export, or transfer the Application to any prohibited country, entity, or person.

11. Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from this EULA shall be resolved in the courts of Poland. If you are a consumer resident in the EU, you may also have the right to bring proceedings in your country of residence.

12. Apple App Store Terms

If you obtained the Application from the Apple App Store, the following additional terms apply:

• This EULA is between you and Wallpyria, not Apple. Wallpyria is solely responsible for the Application
• Apple has no obligation to provide maintenance or support for the Application
• If the Application fails to conform to any warranty, you may notify Apple for a refund. Apple has no other warranty obligation
• Apple is not responsible for addressing any claims by you or third parties relating to the Application
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• You must comply with applicable third-party terms when using the Application

13. Changes to EULA

Wallpyria reserves the right to modify this EULA at any time:

• We will post the updated EULA on our website and within the Application
• Material changes will be notified via the Application or email
• The "Last Updated" date will reflect the most recent changes
• Your continued use after changes constitutes acceptance

If you do not agree to the modified EULA, you must stop using the Application.

14. Severability

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

This EULA constitutes the entire agreement between you and Wallpyria regarding the Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.
