1. Acceptance of Terms

By downloading, installing, or using Wallpyria (the "Software"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

These Terms constitute a legally binding agreement between you and Wallpyria ("we," "us," or "our").

2. Grant of License

Subject to these Terms, Wallpyria grants you a limited, non-exclusive, non-transferable, revocable license to use the Software for personal, non-commercial purposes on your macOS devices.

License Restrictions:

The one-time purchase is tied to your Apple ID and does not expire
You may install the Software on multiple macOS devices you personally own
You may NOT share, resell, sublicense, or redistribute your license
The Software is licensed, not sold

3. Pricing and License Plans

Wallpyria offers the following license:

Lifetime Purchase

Price: $4.99 USD (one-time payment)
Billing: Non-consumable purchase, no recurring charges
Access: Permanent access to all features forever
Updates: All future updates included at no additional cost

Prices are in USD and may vary by region due to currency conversion and local taxes.

4. Free Trial - Full Access

We offer a free trial of 14 days of use with complete access to ALL features:

The trial starts automatically on first launch; only days on which you use the app are counted
ALL features unlocked - no restrictions during trial period
No credit card required for trial activation
Trial does NOT automatically convert to a paid purchase
After trial expiration, a one-time purchase is required to continue using Wallpyria
Trial is available once per user
Trial cannot be combined with other promotions or discounts

Important: Wallpyria does not have a "free version" with limited features. After the 14-day trial ends, you must purchase a lifetime license to continue using the app.

All features are included in the one-time purchase. No feature tiers - everyone gets everything.

7. No Subscription, No Auto-Renewal

Important: Wallpyria is a one-time in-app purchase. Nothing renews and you are never charged again.

There are no monthly or annual plans
You are charged once, at the moment of purchase
There is no billing date and no renewal
Your purchase does not expire
Updates remain included after the purchase

8. Cancellation

There is nothing to cancel:

Wallpyria has no subscription
The one-time purchase does not renew
To stop using Wallpyria, quit the app and delete it
Deleting the app does not refund the purchase
You can reinstall it at any time from the Mac App Store
“Restore Purchases” re-activates it with the same Apple ID

Wallpyria is sold only through the Mac App Store. There are no direct purchases and no license keys.

9. Refund Policy

Wallpyria is purchased through the Mac App Store, so refunds are handled by Apple:

Apple decides whether a refund is granted
We cannot issue refunds ourselves

Apple's refund rules for App Store purchases apply
If Apple grants a refund, the purchase is revoked and full access ends

Apple's Media Services Terms apply to all Mac App Store purchases.

10. Distribution Channels

Wallpyria is distributed only through the following channel:

Mac App Store - With in-app purchases managed by Apple StoreKit
This website (wallpyria.altlogic.pl) only links to the Mac App Store - there is no direct download
Wallpyria is not available on Setapp or any other platform

11. Prohibited Uses

You agree NOT to:

Copy, modify, or create derivative works of the Software
Reverse engineer, decompile, or disassemble the Software
Remove or alter any copyright, trademark, or proprietary notices
Distribute, sublicense, rent, lease, or lend the Software
Use the Software for any illegal or unauthorized purpose
Share or resell your purchase with others
Attempt to circumvent license validation or feature gating
Use the Software in a commercial environment (requires separate commercial license)

12. Intellectual Property

The Software is protected by copyright, trademark, and other intellectual property laws.

Wallpyria and its licensors retain all right, title, and interest in the Software
The Wallpyria name, logo, and trademarks are proprietary to Wallpyria
You do NOT acquire any ownership rights by using the Software
All rights not expressly granted are reserved

13. Updates and Support

Software Updates:

Updates are free for everyone who bought the app
The one-time purchase includes future updates
Updates are delivered via the Mac App Store
We reserve the right to discontinue support for older macOS versions

14. System Requirements

Wallpyria requires:

macOS 14.0 (Sonoma) or later
Apple Silicon (M1/M2/M3/M4) or Intel processor
4GB RAM minimum (8GB recommended for ML features)
100MB available disk space

You are responsible for ensuring your system meets these requirements. We do not guarantee compatibility with unsupported systems.

15. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

We do not warrant that:

The Software will be error-free or uninterrupted
All bugs will be corrected
The Software will meet your specific requirements
The Software will be compatible with all hardware or software

16. Limitation of Liability

IN NO EVENT SHALL WALLPYRIA BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

This includes, but is not limited to:

Loss of data or files
System damage or crashes
Loss of profits or business interruption
Indirect, incidental, or consequential damages

Maximum Liability: Our total liability shall not exceed the amount you paid for the Software in the 12 months preceding the claim.

17. Termination

These Terms are effective until terminated.

By You: You may terminate by uninstalling the Software
By Us: We may terminate your license if you violate these Terms
Upon termination, you must cease all use and destroy all copies of the Software
Refunds are handled by Apple as described in Section 9 (Refund Policy)

18. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wallpyria operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Software shall be resolved through:

Informal negotiation (contact altlogic.pl@gmail.com)
Binding arbitration (if negotiation fails)
Small claims court (for claims under $10,000 USD)

19. Changes to These Terms

We reserve the right to modify these Terms at any time.

Changes will be posted on this page with a new "Last updated" date
Material changes will be announced via email or in-app notification
Continued use of the Software after changes constitutes acceptance
If you disagree with changes, stop using the Software

20. Severability

If any provision of these Terms is held to be unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wallpyria regarding the Software and supersede all prior agreements and understandings.
